The Government has officially issued Resolution No. 09/2026/NQ-CP, an OFFICIAL legal document temporarily suspending the effectiveness of Decree No. 46/2026/NĐ-CP after days of urgent appeals from businesses due to congestion of more than 1,300 trucks, boats, and containers of food at border gates.
The Resolution takes effect immediately from February 4, 2026.
This is the final legal document that government agencies and enterprises nationwide have been waiting for.
I. MOST IMPORTANT CONTENT of RESOLUTION NO. 09/2026/NQ-CP
According to pages 1–2 of the Resolution signed by Deputy Prime Minister Lê Thành Long:
1. Temporary suspension of Decree No. 46/2026/NĐ-CP
- Suspension period: until April 15, 2026.
- Adjustment of implementation timeline:
Decree 46 will officially take effect from April 16, 2026, instead of being applied immediately as previously planned.
2. During the suspension period
- Continue applying Decree No. 15/2018/NĐ-CP and existing guiding documents to ensure the normal customs clearance of imported food.
3. This means that:
→ State inspection authorities must resume accepting dossiers
→ Enterprises can clear goods under previous procedures
→ Fresh food, agricultural products, frozen goods, etc. are released immediately, reducing the risk of spoilage and damage
II. Summary of the previous on-the-ground situation:
Thousands of tons of imported food (vegetables, fruits, seafood, fresh agricultural products, confectionery, etc.) were stuck from January 26 to January 31 due to:
- Food safety inspection agencies suspending dossier acceptance because of a lack of transitional guidance
- Customs being unable to clear goods due to insufficient legal grounds
- Enterprises bearing heavy costs: container detention, cold storage, delivery penalties, quality deterioration, etc.
Specific congestion points:
- Kim Thành (Lào Cai): ~300 trucks stuck
- Hoa Lư (Đồng Nai): 251 trucks
- Tây Ninh – An Giang – Đồng Tháp: hundreds of boats, trucks, and containers
- Seaports in Ho Chi Minh City & Hải Phòng: large numbers of dossiers rejected
